Terms of Service

1. About these terms
These terms govern your use of Told, a family memoir and oral history service operated by RAF B.V. (KvK 92038565), a private limited company registered in the Netherlands at Singel 126, 1015 AE, Amsterdam. In these terms, “Told,” “we,” “us,” and “our” refer to RAF B.V. “You” refers to the person using the service.
By creating an account or using Told, you agree to these terms. If you do not agree, do not use the service.
2. What Told does
Told helps you record, organise, and preserve interviews with family members and others, using AI-assisted features such as transcription, follow-up questions, and chapter organisation, and produces printed books based on the content you create.
We are not a publisher. The content you create belongs to you. Told is a tool you use to capture and shape that content.
3. Your account
You must be at least 18 years old to create an account. You are responsible for keeping your login credentials secure and for any activity that happens under your account.
You must provide accurate information when signing up and keep it up to date. We may suspend or terminate accounts that contain false or misleading information.
4. Recording other people: your responsibilities
This is the most important section of these terms. Please read it carefully.
When you use Told to record someone (referred to here as an “interviewee”), you are responsible for having their permission. By using Told, you confirm and agree that:
- You have the interviewee’s consent to record them, to process their audio through Told and its sub-processors, to generate transcripts and books from that audio, and to store this content in Told.
- You have explained to the interviewee what Told does, including that their audio will be transcribed by AssemblyAI and processed by Anthropic’s AI to organise and enrich the content, and that the content will be stored on Told’s servers.
- You will respect the interviewee’s wishes if they later ask you to delete the recording, remove specific content, or stop recording. Told provides tools for you to do this.
- You will not record anyone secretly or in any way that violates applicable law. Dutch law, and the law of most jurisdictions where you might use Told, requires that all parties to a private conversation know it is being recorded.
- You are the data controller for the personal data in your interviews, including the interviewee’s voice, name, and life information, as well as the names and details of anyone else mentioned in the recordings. Told acts as a processor on your behalf for this content. See our Privacy Policy for what this means.
Suggested practice: at the start of each interview, say out loud something like:
“I’m recording this interview with [name] using Told, an app that will transcribe it and help me turn it into a book about you. The audio will be processed by AI services to do this. Is that okay with you?”
You can use any words you like, but the key point is that the interviewee should clearly understand and agree before you begin.
Sharing summaries with a family circle. Told lets you share short written updates about your conversations, and answers to questions people send in, with a circle of people you choose. If you use this, you also confirm that:
- You have the interviewee’s permission to share written summaries of their stories with the people you invite.
- You have a proper basis to add those people’s names and email addresses to Told and to send them these emails.
- You review and approve the exact text of every update and answer before it is sent. Told only drafts; nothing reaches your circle without your approval, and you are responsible for what you send.
- You will respect a circle member’s choice to unsubscribe, and remove anyone who asks to be taken off.
If an interviewee contacts us directly with a complaint about content you have recorded of them, we may need to share that complaint with you and, depending on the situation, restrict or remove the content.
5. Ownership of your content
You own everything you create with Told: your recordings, transcripts, photos, stories, and books. We do not claim any ownership of your content.
To operate the service, you grant us a limited licence to store, process, transmit, and display your content for the sole purpose of providing Told to you. This licence ends when you delete the content or your account, except where we are required by law to keep limited records.
We will never use your content to train AI models or sell it. We will not share it with anyone outside the sub-processors listed in our Privacy Policy, except the updates and answers you choose to share with a family circle you nominate.
6. Acceptable use
You agree not to use Told to:
- Record anyone without their knowledge or consent
- Upload content that infringes anyone’s intellectual property rights
- Upload content that is illegal, threatening, defamatory, or harmful
- Attempt to break, reverse engineer, or compromise the security of the service
- Use automated tools to access the service in ways we have not authorised
- Resell or sublicense Told to others
- Create books that contain content you do not have rights to
We may suspend or terminate accounts that violate these rules.
7. AI features
Told uses AI to help with transcription, suggested questions, chapter organisation, prose editing, and light historical enrichment. AI output is not perfect. Transcripts may contain errors. Suggested questions may not always be appropriate. Historical context may occasionally be inaccurate.
You are responsible for reviewing AI-generated content before including it in your final book. We provide editing tools for this purpose.
AI also drafts the updates, answers, and reminders for your family circle. As with your book, you review and approve every message before it is sent — nothing goes to your circle automatically.
8. Printed books
Books are printed and shipped by our partner Lulu. When you order a book, you confirm that:
- You have rights to all content in the book, including any photos, quotes, and stories about other people.
- The book is for personal, family use, not for commercial resale.
- The shipping information you provide is accurate.
Prices and shipping options are shown at checkout. Once a print order has been submitted to Lulu, we cannot cancel it because production begins immediately.
If a book arrives damaged or with a clear printing defect, contact us at hello@gettold.app within 14 days of delivery and we will arrange a replacement.
9. Payments
Payments for Told plans, gifts and printed books are processed by Stripe. By making a purchase, you agree to Stripe’s terms.
Prices include applicable VAT where required. Standard shipping is included in the price shown.
10. Your money back
30-day money-back guarantee. If you change your mind within 30 days of paying for a Told plan or a gift, for any reason, we refund the full amount. Email hello@gettold.app; no questions asked.
The guarantee ends once a book from that plan has been submitted for printing, because each book is printed to order and cannot be resold. A book that arrives damaged or with a clear printing defect is reprinted free (see section 8).
You can cancel your Told account at any time. You will not be refunded for past book orders, but you will not be charged for anything new.
11. Service availability
We try to keep Told running smoothly, but we do not guarantee that the service will be available without interruption. We may need to perform maintenance, fix issues, or update the service. We will give reasonable notice for planned downtime where we can.
If you lose access to the service, your data remains stored and available when service is restored.
12. Limitation of liability
To the extent permitted by law:
- Told is provided “as is,” without warranties of any kind beyond those required by Dutch consumer law.
- We are not liable for indirect or consequential losses, including lost data, lost profits, or emotional distress.
- Our total liability for any claim relating to the service is limited to the amount you have paid us in the 12 months before the claim arose.
Nothing in these terms limits liability that cannot be limited by law, including liability for death, personal injury caused by negligence, or fraud.
13. Ending your use of Told
You can delete your account at any time through Settings > Privacy. This deletes your data within 30 days, except records we must keep for legal reasons (such as anonymised tax records).
We may suspend or terminate your account if you breach these terms. Where possible, we will give you notice and a chance to fix the issue first. If we end your account for breach, you may lose access to your content and we may delete it after a reasonable grace period.
14. Changes to these terms
We may update these terms from time to time. When we make material changes, we will notify you by email and in the app at least 30 days before the changes take effect. If you continue using Told after that period, you accept the updated terms. If you do not accept them, you can delete your account.
15. Governing law and disputes
These terms are governed by Dutch law. Disputes will be heard by the competent court in the district of RAF B.V.’s registered seat in the Netherlands, unless mandatory consumer protection law gives you the right to bring proceedings in your own country.
